These are the terms on which Elevate Training Studio is subject to these Terms of Use.

The terms "you" and "your" relate to the user of this site whereas "we," "us," and "our" refer to Elevate Training in these Terms of Use and our Privacy Statement.

You accept these Terms of Use by using this website.

1. USE

Access and use the Elevate Training website (https://www.elevatetraining.au) including the services made through the website.

2. ACCOUNT CREATION

When you visit our website, you can sign-up for an account. After signing-up, you can purchase any membership for package for any of our services listed on the programs page.

While signing-up, it is recommended that you provide correct and relevant information regarding yourself. Please note that all your information shared while creation of account will be dealt in accordance with Privacy policy contained therein.

By signing-up, you warrant that you are at least 18 years of age. Under the age of 18 legally requires your parent or legal guardian to sign these terms and conditions of Elevate Training.

You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do active or passive exercise.

You recognise that the fitness instructor(s) is not able to provide you with medical advice about your fitness and that this information is used as a guideline to the limitations of your ability to exercise.

You agree to not hold any certified trainer or the owners or officers liable for any injury or illness that may occur during a session. You understand that should you feel light-headed, faint, dizzy, nauseated, or experience pain or discomfort, you are to stop the activity and inform your trainer immediately.

Please note that we do not provide any medical assistance or guidance at training. It is advised that you consult with your medical practitioner regarding your health issues and choose the program accordingly.

3. PRICING

All currency references and transactions are processes in Australian Dollars.

Prices are inclusive of goods and services tax (GST).

4. PAYMENTS

Where payment is required, it can be made through our payment system.

All fees and charges include GST unless otherwise specified.

We accept payments using VISA and MasterCard credit cards or direct debit. Payments can also be made onsite in cash.

We only accept credit cards issued in Australia.

Upon signing-up, you authorise us to debit the amount payable from your nominated bank account.

You must not pay, or attempt to pay for services through any fraudulent or unlawful means.

5. CONTENT AVAILABLE ON WEBSITE

This website's content is only offered for general informational purposes. The information on the website was gathered from a number of sources, including information that is generally available to the public, dependable specialised sources, and original contributions.

6. MEMBERSHIP PACKAGES AND RENEWAL

You agree that you have option to cancel your membership with us up to 7 days from the date of the agreement. This facility and option is only applicable to new membership agreements. If you cancel within the 7- day cooling-off period, we will refund your money less any set-up fee or the value of any promotional item we have given you upon joining with us.

Elevate Training reserves the right to remove these packages at any time. This membership would be commencing on the day of purchase. The membership will automatically renew after each period of the membership until you specifically notify us of your intention to terminate your membership. There is a 30-day cancellation notice period on all direct debit memberships. The membership charges are deducted through direct debit.

7. CLASS TERMS & SUSPENSION

There shall be no cancellation of class by members except provided and approved, and any cancellation of class without due approval would entail a $10 fee, which would be debited immediately.

The members may suspend their membership for a period of minimum 1 week. If the suspension continues, then from third week of suspension, the members will be charged $5 per week until the suspension continues.

Along-with, Elevate training may also cancel your membership for following reasons:

- Violation of terms and conditions;
-Any unethical activity;
- Any prohibited act;
- Absence from classes without informing.

8. CONTENT FOR PROMOTIONAL PURPOSES

The members consent that Elevate Training may take photographs of them while training to be used for advertising and promotional purposes. Elevate Training warrants that these photographs shall be used in reasonable manner.

9. INDEMNITY

You agree to indemnify and hold harmless us, the company, employees, agents, officers, from and against any and all liability, damages, losses, costs, expenses, judgments, and reasonable attorney fees arising out of any loss or damage suffered by your act which is result of any negligence act or omission.

Notwithstanding anything to the contrary contained herein, we shall not have any obligation to defend, indemnify, or hold Indemnities harmless you from claims, suits, or damages arising as a result of, or in connection with, willful malfeasance or negligent acts or omissions of Indemnities.

10. DAMAGES AND COSTS

You will be responsible for any damages that are caused by your actions to our systems or equipment’s physically or digitally, you

would be responsible for its own costs, losses, and damages. You will not be liable to one another for any claim related to or arising under this Agreement for consequential, incidental, indirect, or special damages, in case of any damages or loss suffered by you during this training period.

11. CLAIMS

The member is not entitled of any claim or offset against, or defense or counterclaim to, any of its obligations or liabilities against us.

Whereas, the company can lay a claims for any loss or damages caused to it by actions of the member.

12. CHANGES TO WEBSITE

The Website is subject to change at any time without notice and may contain errors.

13. COPYRIGHT ACT

You may copy and use the content in line with the Copyright Act of 1968 (Cth), including fair use for individual research, study, and evaluation.

Additionally, you are permitted to use, duplicate, and distribute the Elevate Training content on this website for any reason, excluding selling it or offering it for a fee, as long as you:

Do not change, adapt, rearrange, or manipulate the content in any way. Do not delete copyright warnings from publications. Credit Elevate Training for all work.
